Welcome to Luminous Lens Studio. These terms and conditions outline the rules and regulations for the use of Luminous Lens Studio's services, located in Seattle, Washington. By accessing our services, you accept these terms and conditions in full. If you disagree with these terms and conditions or any part of these terms and conditions, you must not use our services.

2. Booking and Payment

All bookings are subject to availability and require a non-refundable deposit of 25% of the total service fee to secure the date and time. The remaining balance is due 7 days prior to the scheduled photography session or event. Payments can be made via credit card, debit card, or bank transfer. Late payments may incur a late fee of 5% of the outstanding balance per week.

If the Client reschedules a session with less than 7 days' notice, an additional rescheduling fee of $100 may apply. Cancellations made by the Client will result in forfeiture of the deposit. In the event of cancellation by the Studio due to unforeseen circumstances (e.g., severe weather, photographer illness), the Client will receive a full refund of all payments made or the option to reschedule at no additional cost.

3. Copyright and Usage

The copyright of all Images produced by the Studio remains with Luminous Lens Studio. The Client is granted a non-exclusive, non-transferable license to use the Images for personal use only, including printing, sharing on social media, and displaying in their home. Commercial use of the Images requires prior written consent from the Studio and may be subject to additional licensing fees. The Client may not alter, modify, or sell the Images without the Studio's permission. Any unauthorized use of the Images will be considered a copyright infringement and may be subject to legal action.

Luminous Lens Studio retains the right to use the Images for promotional purposes, including but not limited to website display, social media marketing, and portfolio showcases. If the Client prefers that their Images not be used for promotional purposes, they must notify the Studio in writing prior to the photography session.

4. Liability

Luminous Lens Studio will take all reasonable care in providing the Services. However, the Studio is not liable for any loss, damage, or injury to persons or property that may occur during the photography session or event, except in cases of gross negligence or willful misconduct on the part of the Studio or its employees. The Client is responsible for ensuring the safety of themselves and their guests during the session. The Studio is not responsible for any third-party services or products used in connection with the Services, such as hair and makeup artists or venue rentals.

In the unlikely event of equipment malfunction or data loss, the Studio's liability is limited to a full refund of all payments made by the Client or the option to reschedule the session at no additional cost. The Studio is not liable for any consequential damages, including but not limited to lost profits, emotional distress, or business interruption.

5. Image Delivery and Archiving

The Studio will deliver the edited Images to the Client within 4-6 weeks of the photography session or event. The Images will be provided in a high-resolution digital format via a secure online gallery. The Client is responsible for downloading and backing up the Images. The Studio will archive the Images for a period of one year from the date of delivery. After this period, the Studio reserves the right to delete the Images from its archives.

Additional services, such as prints, albums, and canvases, are available for purchase and will be subject to additional fees and delivery times. The Studio is not responsible for the quality of prints or products ordered from third-party vendors.

6. Conduct

The Client and their guests are expected to conduct themselves in a respectful and courteous manner during the photography session or event. The Studio reserves the right to terminate the session if the Client or their guests engage in behavior that is disruptive, abusive, or unsafe. In such cases, the Client will forfeit the deposit and any other payments made.

The Studio adheres to a strict code of ethics and will not engage in any photography that is illegal, unethical, or harmful to individuals or the environment.

7. Force Majeure

Neither party shall be liable for any failure to perform its obligations under these terms and conditions if such failure is caused by an event beyond its reasonable control, including but not limited to acts of God, war, terrorism, riots, strikes, epidemics, or governmental regulations. In such cases, the affected party shall promptly notify the other party and make reasonable efforts to mitigate the impact of the event.

8. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law principles. Any disputes arising under or in connection with these terms and conditions shall be resolved in the state or federal courts located in Seattle, Washington.

9. Changes to Terms and Conditions

Luminous Lens Studio reserves the right to modify these terms and conditions at any time without prior notice. The updated terms and conditions will be posted on the Studio's website and will be effective immediately upon posting. It is the Client's responsibility to review these terms and conditions periodically for any changes. Continued use of the Services after any such changes constitutes acceptance of the new terms and conditions.
